Technology & Data Breach

Technology & Data Breach

Our technology and data breach team has notable expertise in resolving complex technology disputes and is at the cutting edge of pursuing data protection collective actions.

Our cross-practice group draws together specialist lawyers from our market leading antitrust/competition and commercial and financial disputes practices.  We have in-depth expertise across a variety of areas, including:

  • Commercial disputes arising from technology projects
  • Software licensing disputes
  • Intellectual property disputes
  • Data breach & privacy
  • Claims arising from infringements of competition law in the technology sector

We work with a diverse range of clients including blue chip corporates, technology companies, trade and industry associations, public bodies and private individuals. We are rarely conflicted and can act against major tech companies – including Google, Amazon, Facebook and Apple – where other firms cannot.

Our commercial litigation work includes contentious advisory and disputes work arising from troubled IT projects, together with breach of confidence, software licensing work and cryptoassets including the recovery of lost and stolen assets. Our team has a long, established track record in this area.

We have a particularly active data protection practice, drawing on our extensive experience in pursuing collective actions. In 2020 we filed three UK representative actions relating to data breaches (against Marriott, YouTube and Facebook) - more than any other firm.

In the competition space we are active in relation to several abuse of dominance and merger control matters in the technology sector.

Our funding experience sets us apart from our competitors: we offer flexible fee arrangements and can share risk. We have longstanding relationships with many litigation funders and are accustomed to putting in place tailored funding arrangements for our clients.

We have international reach through our network of offices across the US and Europe and our cases regularly involve global teams. Our international work includes matters in Brussels (EC investigations), Luxembourg (European court work), Delaware (International Arbitration) and the Czech Republic.

Our team are frequent contributors to leading legal journals and are regular speakers in specialist conferences and the national media.

'Their sweet spot is collective actions. If you are bringing those kinds of cases they are going to be big ticket and the defendants will be well represented, so you need to have high-quality representation,' states one interviewee, going on to note: 'The firm is able to draw on its US experience where it is an obvious market leader, and I think it has helped shape the market here to a certain extent.'

Another source reports: 'They are able to perform an invaluable role in terms of pulling teams of economists together and having discussions with funders; they certainly have the network to handle these cases.'

Interviewees say that 'for claimant work, Hausfeld clearly leads the pack,' noting it is 'right to say that they are in a class of their own on the claimant side.' A source reports that this is a 'very dynamic, forward-thinking and pragmatic team, who are also fun to work with.'
