Competition damages symposium
There is increasing jurisprudence on how causation and quantum should be assessed in competition damages cases following judgments in Trucks, BritNed and Achilles v Network Rail in the last few years. With many more cartel and abuse of dominance cases coming through the Competition Appeal Tribunal.
Together with Linklaters and Alix Partners, we host an afternoon chaired by Sir Peter Roth, former President of the Competition Appeal Tribunal, during which two expert panels of lawyers, barristers, and funders will share their views.
- Panel on causation: How do the courts/CAT approach the assessment of a causal link between infringement and harm? To what extent do (and should) they weigh the relative importance of legal argument, factual evidence and expert evidence in considering causation?
- Panel on quantum: How do the courts/CAT approach the assessment of quantum? Which techniques are favoured and do they provide a sound basis for assessing quantum?
