BIICL - The Total climate case: lessons learned and future prospects

The BIICL is organising a webinar, chaired by Ingrid Gubbay, considering the Total climate case. In this trial, the Paris Court will have to assess the responsibility of the French oil company Total in climate change. 

Climate litigation is developing in a large number of countries around the world. Alongside lawsuits against states, there are more and more lawsuits against companies. The arguments of the plaintiffs in the Total case are similar to those invoked in the Shell case in the Netherlands.

Taking stock from comparative experiences in other legal systems, the panel will consider:

  • What are its legal bases?
  • What are its chances of success and
  • What is its place within all climate trials? 

Panellists are Professor Mathilde Hautereau-Boutonnet, Professor of Law, Aix-Marseille University; Dr. Joana Setzer, Assistant Professorial Research Fellow, Grantham Research Institute on Climate Change and the Environment, London School of Economics and Political Science; and Professor Jaap Spier,  Former Advocate-General in the Supreme Court of the Netherlands, Extraordinary Professor of Global Challenges, University of Stellenbosch and Senior Associate, University of Cambridge, Institute for Sustainability Leadership.
