Arbitration agreements in commercial aviation contracts and the Hague court of arbitration for aviation
In an article published in Air & Space Law by Wolters Kluwer, Hausfeld Partner Ned Beale and Smith, Gambrell & Russel Partner, Ben Graham-Evans provide an overview of the use of arbitration agreements in commercial aviation contracts, especially lease agreements, with particular reference to the establishment of the Hague Court of Arbitration for Aviation in July 2022.
It considers the advantages and disadvantages of arbitration agreements, as an alternative to the state court jurisdiction clauses, in commercial aviation contracts, for example wet and dry aircraft leases and aircraft sale, finance, manufacturing and servicing agreements. It also reviews the unique features of the Hague Court of Arbitration for Aviation, its benefits as compared to other arbitral institutions and state court and discusses the institution’s long-term prospects.
