2025 marked a decade since the entry into force of the opt-out collective actions regime in competition law. This decennial was also a threshold year for the regime, as it produced the first successful damages award to a class in the Kent v Apple proceedings and the first collective settlement fully disposing of a collective claim in the Merricks v Mastercard proceedings.
