April 2: 10:45am – noon: Scott Martin will join the “Bridging Moats: Targeting Monopoly Entrenchment” panel.
“The FTC and DOJ have focused on monopolists’ exclusionary tactics such as “moat-building” and entrenchment. These theories show up in Section 2 cases as well as in merger suits in the United States. The European Commission and the CMA also wrestle with the topic. The panel will delve into recent enforcement actions to understand the trends in US, EU and UK approach to monopoly entrenchment and moat-building.”
April 2: 3:30pm – 5pm: Swathi Bojedla will join the “Effectively Communicating with Diverse Juries” panel.
“Effectively Communicating with Diverse Juries” invites top antitrust trial experts from both sides of the "v." and a diverse mock juror as they explore strategies for effectively communicating complex legal concepts to diverse juries. This interactive session provides practical insights into tailoring arguments, addressing cultural nuances, and ensuring clarity while ultimately enhancing your case's impact and persuasiveness.
April 3: 8:30am – 10am: Megan E. Jones will participate in the panel discussion “Building Effective Expert Testimony.”
“Building Effective Expert Testimony” panel discusses how cases can live or die on what experts do (or don't do). What is the role of experts in antitrust cases? How do we make economics persuasive (and admissible!) to diverse factfinders? What new methodologies can experts use? How are trial themes integrated into expert work? The panelists will teach all of this and much more.
April 3: 3:30pm – 5pm: Michael D. Hausfeld will join the “The Growth of Private Actions Targeting Dominance” panel.
“The Growth of Private Actions Targeting Dominance” discussion explores how alongside rising US and international government enforcement against dominant firms, private enforcement has increased, particularly stand-alone claims without prior infringement findings by a government enforcer. Why has there been an increase in private stand-alone claims against dominant firms? What are the benefits and drawbacks associated with bringing private actions before government enforcement actions result in an infringement finding?"
