The Lawyer's Top 10 appeals of 2023

The Lawyer recognised the importance of the upcoming Supreme Court hearing in The Manchester Ship Canal Company v United Utilities Water by including it in their Top 10 Appeals for 2023.

The issue of untreated sewage in England’s rivers and seas has received significant public and media attention in recent months, as illustrated by the fact the first investigation to be conducted before by the newly instituted Office for Environmental Protection concerns sewage pollution.

Sarah Moore, Wessen Jazrawi and Hana Tawfik are representing a consortium of individuals and groups with a keen interest in the health of rivers and waterways in the UK, and obtained permission to intervene in this major environmental case. The intervention supports MSCCL’s argument that the Water Industry Act 1991 does not preclude private individuals from advancing common law claims against water utility companies, including tortious actions concerning the release of untreated sewage into waterways. 6 March 2023 will be an important date in the environmental diary.
