Collective actions symposium: the road ahead
August 2021 saw a key milestone for the opt-out collective regime, with the Competition Appeal Tribunal certifying its first application for a collective proceedings order in Merricks v Mastercard. It was seen as the green light for the collective redress regime in the UK, but challenges remain.
Hosts Alix Partners, Brick Court Chambers and Hausfeld offered an afternoon chaired by Sir Gerald Barling, former President of the Competition Appeal Tribunal, during which two expert panels of lawyers, barristers, economists and funders shared their views from the claimant as well as defendant perspective. In a third panel, and for the first time ever, we brought together several class representatives to gain first-hand insight in their experience of the UK collective actions regime thus far.
- Panel 1. Lessons learned about bringing collective actions before the CAT to date, and how this may help shape the future.
- Panel 2. How can the regime evolve to deal with challenges.
- Panel 3. Perspectives from consumer champions and class representatives in bringing collective actions.
