“Don’t Try Them Until You Mock Them” looks at how more antitrust cases are going the distance, and the stakes are high. Do you know how to distill your case to key themes and make it understandable and compelling to jurors? What can you test in jury research? When should you do a mock trial and how do you interpret the results? And what the heck is a "clopening" anyway? Hear what experience has taught us and see trial themes developed live.
“NIL After Alston: Wild West?” discusses how Alston and O'Bannon helped open up a market for college athletes' names, images, and likenesses that did not exist 10 years ago. This panel will explore how college athletes, universities, and conferences are navigating the antitrust implications of group licensing, transfers, and recruiting in the NIL era.
The “Failure to Communicate? Improving Expert Testimony” discussion will be a response to a call by esteemed judges to revisit the current approach to presenting expert testimony in the courtroom and to regulators. This roundtable will explore what strategies can be applied to enhance the clarity and persuasiveness of expert testimony and presentations.
