Hausfeld & NYU School of Law Present - Microsoft @ 25: Impact, Influence, and Legacy

June 28, 2026 will mark the 25th anniversary of the D.C. Circuit Court of Appeals’ decision in United States v. Microsoft.  In anticipation of that anniversary this conference will consider Microsoft’s impact on the development of U.S. monopoly law and policy, its influence on the economic analysis of digital markets, and its durable legacy.  Although the Microsoft decision had limited impact at first, the case now stands at the center of an unprecedented wave of private and public antitrust challenges to some of today’s largest technology firms.  Understanding and evaluating how Microsoft has affected these challenges will be the central focus of this conference.

The conference explores key issues in antitrust law and its evolution in response to the digital age, with a focus on monopolization, economics, remedies, and the future of technology.

  • Panel 1, The Development of Monopolization Law, examines the development of monopolization law, asking how cases against modern tech giants like Google and Amazon would be framed under older legal tests and whether Microsoft’s approach has led courts down the right or wrong path.
  • Panel 2, The Economics of Platforms and Innovation, delves into the economics of digital platforms, assessing how Microsoft’s case influenced economic theories of network effects and platform competition, and whether current economic theories better inform antitrust law today.
  • Panel 3, The Challenge of Remedy, focuses on the challenges of remedies in monopolization cases, reflecting on the effectiveness and criticisms of Microsoft’s settlement, and considering whether current cases might require alternative solutions, including regulatory approaches.
  • Finally, Panel 4, Antitrust and Technology’s Future, looks to the future of antitrust, questioning how enforcement can anticipate technological changes such as AI and content moderation, and whether current policies can balance competition with innovation in rapidly evolving markets.

The Microsoft @ 25: Impact, Influence, and Legacy conference will take place on Friday, February 21, 2024 at the NYU School of Law.
