OVERVIEW
Philipp Westerhoff is Counsel at Hausfeld in Berlin. He advises clients on EU and German competition, media, and regulatory law with a special focus on antitrust litigation.
Philipp is specialized in representing parties in complex private enforcement actions before the German courts, notably in disputes related to digital markets and ecosystems, and often with regard to applications for interim injunctions and damages actions based on the abuse of market power.
In addition, Philipp represents complainants in investigations based on antitrust law and/or the EU’s Digital Markets Act (DMA) before authorities at both European and national levels, in particular relating to digital media and advertising technology (AdTech) and often against Big Tech companies such as Google, Apple, Amazon, and Microsoft.
His activities in cases before the European Commission and the CJEU such as Google Search (Shopping), Google Android, and Microsoft Teams or in the Bundeskartellamt‘s investigation into Apple’s so-called App Tracking Transparency (ATT) framework along with several landmark interim injunction cases (e.g., Netdoktor v Google, Immowelt v Immoscout) have attracted special attention. Philipp also frequently represents software developers and others in disputes related to account blockings (e.g., app stores, merchant, or advertising accounts etc.).
The Who's Who Legal (WWL) Guide on Competition 2023 recognizes Philipp as one of the Global Leaders (Germany - Competition Plaintiff).
Following his studies at the University of Cologne, Humboldt-University in Berlin, the University of Paris 2 (Panthéon-Assas) and King’s College London, Philipp holds a Maîtrise en droit (European Law) and an LL.M. in Competition Law. He frequently writes articles on German and EU competition law and market regulation and was nominated several times for Antitrust Writing Awards by Concurrences.
