At the Competition and Markets Authority, Nanret obtained litigation experience in the following areas:
• Appeals of CA98 decisions on pharmaceutical drugs: advised on multi-party CA98 appeals and worked on complex confidentiality reviews in support of these cases. Experience includes the Phenytoin appeals (CMA v Flynn Pharma and Pfizer) before the Court of Appeal and Liothyronine appeals (Hg Capital, Cinven S.A.R.L, Mercury Pharmaceuticals) before the Competition Appeal Tribunal.
• Market studies and investigations: advised on the statutory appeals of the CMA’s market investigation on mobile radio network services, and the CMA’s decision to launch a market investigation on mobile browsers and cloud gaming in the UK.
• Merger investigations: part of the legal team considering the Meta/Giphy Phase 2 merger inquiry and heavily involved in advising on Meta’s challenge to the merger decision heard by the Competition Appeal Tribunal.
• Administrative penalties: advised on two administrative penalties imposed on Meta Platforms, Inc in relation to failures to comply with an interim enforcement order (IEO). The penalties (£50.5 million and £1.5 million respectively) were the highest and third highest IEO administrative penalties ever issued by the CMA at that time.
