Examples of Jonathan’s commercial disputes experience include acting for:

  • The entrepreneur founder and seller of a healthcare business, defending post-acquisition warranty and indemnity claims in the High Court brought by the private equity buyer and securing substantial pre-action recoveries in multiple negligence claims against each of the seller’s former accountants, lawyers and financial advisers.
  • Qatar Airways, in a strategic role arising out of its multi-billion dollar dispute with Airbus concerning its A350 and A321 Neo fleets (one of The Lawyer’s Top 20 Cases of 2023).
  • An international energy developer in Commercial Court proceedings involving a dispute with an international investment bank relating to FX trades under the 2002 International Swaps and Derivatives Association (ISDA) Master Agreement.
  • The developer of intelligent flight savings software, in its claims against a global travel corporation, alleging the misappropriation of the client’s software.
  • Institutional investors with s90/90A FSMA claims against listed companies.
  • Representative parties to group litigation brought pursuant to CPR 19.8.

 
Before Hausfeld, his experience included:

  • Acting for the Danish Tax Agency, Skatteforvaltningen, in fraud and misrepresentation claims against over 100 defendants arising from “cum ex” dividend arbitrage trading, where withholding tax refunds on dividends were allegedly claimed despite there being no shares or dividends paid. The proceedings were described as “one of the largest and most complex pieces of litigation to be heard in the Commercial Court” (one of The Lawyer’s Top 20 Cases of 2021 and 2024).
  • Representing a local authority in an expert determination concerning a contractual dispute to an enforce an option to buy land with a developer.
  • Defending complex unfair prejudice petitions under s994 of the Companies Act 2006 for a private equity investor.
  • Acting as part of a s166 Financial Services and Markets Act skilled person team in a major review into the mis-selling of interest rate hedging products by two high-street UK banks.

Antitrust / Competition

At Hausfeld, Jonathan is part of the teams acting for:

  • Dr Rachael Kent, the class representative in CAT proceedings on behalf of some 19.6 million eligible UK iPhone and iPad users relating to excessive and unlawful charges by the Apple App Store. The claim alleges that Apple’s conduct violates section 18 of the UK Competition Act 1998 and Article 102 of the Treaty on the Functioning of the European Union.
  • a proposed class representative in collective proceedings filed against Amazon.com, Inc. seeking damages on behalf of consumers for alleged anticompetitive conduct in relation to Amazon’s ‘Buy Box’.


At his previous firm, Jonathan, was part of the legal teams:

  • Acting for a claimant in multilateral interchange fee claims against Visa and MasterCard.
  • Advising a claimant impacted by the auto-parts cartel infringement.
  • Advising university clients in relation to claims for an alleged abuse of a dominant position in the market for graduation gowns.
