Antitrust/Competition

Anthony has advised on or represented, often as lead partner, in respect of:

  • The Marine Hose cartel on behalf of 50+ oil companies from across the globe resulting in the innovative Parker Settlement.
  • Acting on behalf of individual and business clients in relation to the alleged use by Mercedes of so-called ‘defeat devices’ for the purposes of cheating emissions testing. The team have issued claims on behalf of thousands of clients affected by Mercedes’ alleged conduct and are part of the Steering Committee of firms running the litigation.
  • The Paraffin Wax cartel for a group of over 30 European businesses against Shell, Exxon and other oil companies in.
  • Trains - The very first collective claim filed by Hausfeld back in February 2019, with co-counsel Charles Lyndon. It was also the first collective claim brought before the CAT on a standalone basis. Crucially for the regime more generally, in July 2022 the Court of Appeal held in Trains that liability can be determined on an aggregate basis in collective proceedings, which was a very important ruling for collective proceedings in the UK. We helped progress the case over 5 years during which the claim benefited from our competition litigation expertise.
  • The Car Glass cartel.
  • The Carbon Graphite cartel for a group of European rail companies.
  • Air Cargo cartel litigation which was run by Hausfeld for over 400 businesses against BA.
  • The Air Passenger settlement against BA/Virgin.
  • LIBOR claims.

Collective Redress

Anthony was one of the partners leading the team on:

  • Filing of a representative collective action with the CAT on behalf of the Consumers’ Association (known as Which?) against Qualcomm on behalf of a class of around 29 million UK consumers alleging that Qualcomm abuses its dominance in the markets for smartphone chipsets and standard essential patents, the result of which is that Qualcomm is able to overcharge smartphone manufacturers for its technology.  
  • Air Cargo - Hausfeld pursued claims for losses that occurred in over 50 different jurisdictions as a result of the Air Cargo Cartel, ultimately representing 400 claimant entities - including a significant number of multinationals - against British Airways plc and 13 Part 20 Defendant Airlines in some of the longest running, most high-profile and complex competition damages actions brought to date in the English Courts. He was instrumental on bringing the 6-month mediation to a satisfactory close.
