Air Cargo claimants win right to appeal UK High Court ruling

On Friday 1 December, the English High Court granted the air cargo Claimants permission to appeal the judgment handed down by that same Court on 4 October 2017, which had restricted their ability to claim damages from British Airways in respect of air freight services purchased on flights on certain routes affected by the cartel in the period prior to May 2004.
Having heard the parties’ submissions at a half-day hearing, Mrs Justice Rose held that the matter concerned complex points of European law in relation to which the Claimants have a real prospect of succeeding on an appeal to the Court of Appeal.
The High Court’s grant of permission to appeal the October judgment will ensure the continuing momentum of our clients’ claims against BA; who, in mid-November, lost its battle in the European Courts to overturn the original infringement decision of the European Commission on which our clients’ claims are based.
