Ro-Ro class action claim filed at UK Tribunal

On 20 February 2020, Mark McLaren Class Representative Limited, filed an opt-out class action to the Competition Appeal Tribunal for damages against Mitsui OSK Lines, K Line, NYK Line, Wallenius Wilhelmsen Logistics/EUKOR and Compañía Sudamericana de Vapores (CSAV).

The opt-out claim includes all customers who bought certain cars between 2006 and 2015, therefore involving millions of cars, and millions of potential consumers.

Partner and competition disputes specialist, Tom Bolster, who has represented several car manufacturers in claims against the Ro-Ro cartel, spoke to Ciaran Willis of Global Competition Review:

“While this claim seems straightforward…it appears to assume that those delivery charges are a true reflection of shipping costs. That seems a big leap. Some press outlets have said that delivery charges allegedly amount to up to £60, and averaged around £9 per car, but that seems on the low side, as deep-sea shipping costs within the scope of this decision can amount to several hundred pounds per car.”
