Industrial Chemicals: MDI and TDI

Hausfeld is court-appointed Co-Lead Counsel in this multidistrict litigation, representing a proposed class of direct purchasers of the industrial chemicals methylene diphenyl diisocyanate (MDI) and toluene diisocyanate (TDI) in claims against major industrial suppliers for conspiring to artificially inflate prices in violation of federal antitrust law.

MDI and TDI are precursor ingredients for the polyurethane foams and thermoplastic polyurethanes that are used to make thousands of consumer products, such as foam mattresses, car seats, refrigerator insulation, and other common products.  Plaintiffs allege that Covestro, BASF, Dow, Huntsman, and Wanhua conspired to inflate the prices of MDI and TDI in the United States through coordinated tightening of production and lockstep price increases from at least January 1, 2016 through the present. In defeating defendants’ motion to dismiss in early 2020 the firm secured a judicial determination as to the viability of Plaintiffs’ claims. The case is now proceeding through discovery of the five Defendants.

Judge Donetta Ambrose in the Western District of Pennsylvania appointed Hausfeld’s Megan E. Jones as interim Co-Lead Counsel for the class.
