In December 2011, the European Commission (“EC”) fined seven refrigeration manufacturers a total of €161.2 million for operating a price-fixing cartel that covered the whole European Economic Area (“EEA”) from April 2004 until October 2007.

The Cartel

Among those companies named in the EC Decision as cartelists are ACC, Danfoss, Embraco, Panasonic and Tecumseh. The cartelists coordinated European pricing policies and kept market shares stable in an attempt to recover cost increases. 

The cartel concerned small hermetic reciprocating compressors (maximum 1.5 horsepower or “HP”) that are used predominantly in household appliances, such as fridges and freezers, as well as in commercial equipment such as vending machines, ice cream coolers.
