Hausfeld represents end-payer plaintiffs in historic antitrust price-fixing litigation against some of the largest generic pharmaceutical companies in the world. To date, more than 100 complaints have been filed alleging anticompetitive conspiracies spanning dozens of generic drugs. The alleged misconduct—unlawfully colluding on the prices of numerous key generic drugs sold throughout the United States—has caused direct and indirect purchasers, including health and welfare funds and consumers, to overpay for prescription generic drugs.

There is a concurrent, ongoing federal criminal investigation, led by the Antitrust Division of the United States Department of Justice (DOJ) and a 47-state investigation, led by the Attorney General of Connecticut. To date, these investigations have resulted in price-fixing guilty pleas from two senior executives at defendant Heritage Pharmaceuticals, Inc. relating to the sale of generic glyburide and doxycycline hyclate.

The cases have been consolidated before Judge Cynthia Rufe in the Eastern District of Pennsylvania under the caption In re: Generic Pharmaceuticals Pricing Antitrust Litigation, MDL 2724 (E.D. PA). On November 28, 2016, the court appointed Hausfeld to the Plaintiffs’ Steering Committee, which has responsibility for litigating the case.
