Hausfeld represents dentists and dental labs in a suit brought against Henry Schein, Inc., Patterson Companies, Inc., Benco Dental Supply Company, and Burkhart Dental Supply Co., the four largest distributors of dental supplies and equipment in the United States.
The suit alleges that the defendants, who collectively control some 80% of the dental supplies and equipment distribution market, have been engaged in a long-running agreement in restraint of trade that involved agreements not to compete on price, the allocation of customers, and group boycotts of lower-priced rivals and competitive platforms such as group purchasing organizations.
The case is pending before the Honorable Brian M. Cogan of the Eastern District of New York, who appointed Hausfeld and three other firms as co-lead counsel in February of 2016. Hausfeld attorneys working on this matter are Brent Landau and Gary Smith.
In September 2018, a tentative deal was reached to fully resolve the action for $80 million. The proposed settlement was reached after the plaintiffs had completed discovery and fully briefed Plaintiffs’ class certification motion and the Defendants’ Daubert motions, but before a decision on those motion had been issued.
